La Mar No. 390, district of Miraflores, province and department of Lima (hereinafter " KUKYFLOR "), includes in this document the policy of use of photos and/or videos that its clients send through https://www.kukyflor.com/es/ (the “ KUKYFLOR Web ”).
KUKYFLOR customers have the option of sending, along with the purchase of their order, a printed photograph and/or a video that will be delivered via a QR code to the recipient. KUKYFLOR is aware that this includes the processing of customers' personal data, such as the use of their image and voice. It may also involve the use of the image and voice appearing in the photograph or video.
In this regard, the only use that KUKYFLOR will give to the photographs and/or videos of the clients is to send it as part of the client's order to its final recipient. The photos will be sent in a printed file, while the videos will be stored in a QR ( quick response code ), which is a way to store information. Therefore, the purpose of processing this personal data is exclusively to comply with the obligation assumed towards the client in sending the photograph and/or video to the final recipient.
KUKYFLOR recognizes the importance of respecting the rights regarding the protection of personal data. Therefore, it has adopted the following protection measures in relation to the photographs and/or videos it receives:
The personnel in charge of receiving and sending the photographs and/or videos will be trained on the protection of personal data, regarding the proper treatment of the personal data found in said files.
The files of the photographs will be deleted from the KUKYFLOR system within 48 hours of having sent them to the final recipient. Likewise, any printing made in excess or by mistake of a photograph will proceed with its immediate destruction.
The QR of the videos will be disabled 48 hours after the order has been delivered to the final recipient. Likewise, the video file will be deleted from the KUKYFLOR systems within the same period indicated above.
Both the QR and the printed photographs will be sent to the final recipients in sealed envelopes and with an external sealed wrapper.
The client is responsible for obtaining the consent, in accordance with the law, of the people who appear in the images and/or videos that they send to KUKYFLOR, so that KUKYFLOR can deliver the order together with the images and/or videos. Likewise, regarding the sending of photographs and/or videos, the client is responsible for ensuring respect for public order regulations. For this, KUKYFLOR will proceed to arbitrarily filter, under the support of respect for public order regulations, which photographs and/or videos do qualify to be sent to their final recipient. If the filter does not pass, the customer will be notified immediately and the order will be sent without the photograph and/or videos.
It should be noted that KUKYFLOR has, among others, the following databases registered with the National Authority for the Protection of Personal Data and for which these images and videos have an impact:
